Personal Information Protection Policy – Big C PLUS Application
Big C Supercenter PCL including subsidiaries and affiliates of Big C Supercenter PCL ("Company") considers the importance of our customers' and/or users' personal information, hence, it is deemed that the Company will collect, use, process and/or disclose and/or transfer personal information related to our customers and/or users only to the extend of purpose specified in this Personal Information Protection Policy and and Consent Form provided by customers and/or users.
This Personal Information Protection Policy describes types of personal information to be collected, purposes of the collection, use, process, disclosure and/or transfer of customers' and/or users personal information, the person(s) that the Company may disclose such information to, rights of customers and/or users as an owner of the personal information, duration of data collection, security measures, including other information related to personal information management of the Company. This Personal Information Policy is an integral part of the terms and conditions of our services. Please read and understand this Personal Information Protection ("Policy") to learn our policies and practices on management and protection of customers' and/or users' personal information ("Client")
This Policy shall apply to any information that the Client has provided to the Company when applying to one of Company services or when purchasing Company's products, or when Client has provided to the Company or when the Client has permitted an access to the Company, which related to the Client and such information can identify the Client's identity directly or indirectly ("Personal Information"). This shall include the following information.
(A) Personal information i.e., name, surname, IC card number, telephone number, date of birth, gender, email, contact address, address as shown in house registration, and other information required upon registration for use of any services of the Company.
(B) Any other information that can identify the identity of the Client.
(C) Information related to spending, consumption behavior, service position used, and/or the Client's interest when combined with other information and can identify information's owner.
(D) The Company may collect such personal information directly from you and/or other sources of data opened in public domains in the event when you have provided other person's personal information to the Company i.e., name, surname and telephone number of an emergency contact. The Client affirms that he/she has notified such person about the disclosure and storage of the personal information by the Company
and that such person has given his/her consent to the Client for the storage, use and disclosure of personal information in accordance to this Policy.
(E) To be able to provide services that meet your requirement, the Company may have access to the information related to your interest and/or preferences, marketing research and consumers' opinion that you have voluntarily disclosed to the Company related to the use of products and services of the Company and/or visit data on websites by cookies in the website and/or Company's applications are collected through website cookies and application and the Company has an access to such information.
The Company may record the communication between the Client and the Company i.e., telephones, email correspondence, company's application, application used for communication, call center or any other channel. The record of such information is for different purposes, for example, for use as an evidence of communication, for development and improvement of our services, for monitoring customers' satisfaction, for personnel training purposes, for data analysis including for development of our service systems.
As a patents or legal guardian, please do not allow your minor providing his/her personal information to the Company without your supervision. In case such minor has provided information to the company, it shall be deemed that the parents or legal guardian has given their consent to the Company for the collection, use, process, disclosure and/or transfer personal information of the minors, and that parents or legal guardian has agreed to be responsible for the minor's action.
3. The purpose of storage, process, disclosure and/or transfer of the Client's personal information.
The Company may store, use, process, disclose and/or transfer the Client's personal information for the following purposes:
(a) To achieve objectives related to preparation of historical documents or archives for public interest or that related to study or researches or statistic which has in place appropriate protection measure for for protection of rights and freedom of the Client.
(b) To prevent or suppress hazard to a person's life, body or health.
(c) To comply with the contract where the Client is a contractual party with the Company, or for proceed in accordance with the Client's request prior entering into such contract with the Company.
(d) To perform duties in accomplishing tasks for the public interest or to perform the duties in exercising authority provided to the Company.
(e) For legitimate benefits of the Company or of an individual or other juristic person other than the Company unless such benefit is less important than basic rights in personal information of the Client.
(f) To comply with the law and/or policies of the Company.
(g) To create the rights of claim according to the law, the compliance or exercise of right of cliam or to raise against right of claim of the Company.
(h) To verify the Client's identity.
(i) To compare and verify information with external person for confirmation of data accuracy
(j) To proceed or support the sales of products and/or services to the Client.
(k) To develop and improve forms or efficiency of product sales and/or services provided to the Client.
(l) For researches, monitoring, processing and analysis your information for improvement and adjustment of products, goods and/or services, or the development and presentation of new products, goods and/or services to meet Clients' need, or to promote marketing activities, sales promotion, including product publicity, products and/or services whether presented by the Company or business alliances of the Company;
(m) To study purchasing behavior and/or services provided to the Client.
(n) To contact for news and information, or to contact for marketing research through various channels including mobile phones, emails, home address and other channels according to the data provided to the Company and;
(o) For any other matters related to the sales of products and/or service provision by the Company;
(p) For any other matters within the scope of purposes the Client has provided to the Company as specified in Personal Information Consent Form.
The Company may disclose the Client's personal information to the third party as followings:
- 4.1 Affiliates of the Company or company group of which the Company has jointly invest The Company may disclose such personal information to its affiliates or company group of which the Company has jointly invest (in Thailand and oversea) including the company assigned as a data processor. The assigned entity will process and disclose the information only to the extend of purpose specified herein and disclose to the person specified in this Policy only.
- 4.2 Service providers of the Company The Company may disclose the personal information to its service providers including government agencies which the Company has requested the services. The said service providers will use such personal information to the extend as permitted by the Company and in accordance to this Policy only. The disclosure shall be made to the necessary extend only. an example of services providers are as follows:
- Consultants, i.e., auditors, financial advisors, legal advisors.
- Infrastructure system and information technology service provider
- Data storage service provider
- Marketing service provider, research service provider, data and statistic service provider.
- Advertisement agency, public relations agency and communication agency
- Application Service Provider
- Service provider related to systems and payment network and payment service providers.
- Financial institutions and other third parties that the Company uses to provide services to you
- Data validation service providers
- 4.3 Business alliances of the Company The Company may disclose the personal information to other person who has agreed with the Company, such as financial institutions, insurance companies.
- 4.4 Any other person as stipulated by law When it is required to disclose the personal information to any other person as stipulated by law in case there is applicable law, regulations, rules, an order of government agency, the authority responsible for overseeing or the court order or judgment.
- 4.5 Assignee of right and/or duties from the Company in the event where the Company wishes to assign its right and duties including business assignment whether in part or in whole, merger, and reorganization of shareholding of the Company, the Company must disclose the personal information to assignee where the rights and duties of assignee regarding personal information shall be in accordance to this Policy.
The information disclosure as aforementioned may include the disclosure of information within Thailand or oversea. The Client gives consent that the Company will transfer or send such information oversea despite the particular country has insufficient or less privacy standard for personal information protection, comparing to Thailand.
As an owner of personal information, the Client shall have rights as follows:
- 5.1 Consent
The Client has the right to provide his/her personal information to the Company, including the right to give consent to the Company for storage, use or disclose such personal information. However, if such personal information is incomplete, inaccurate as requested by the Company or the Client does not give consent to store, use or disclose, the Company is not able to provide products and/or services to the Client or that the Client may not receive any client privileges.
- 5.2 Data access
The Client has the right to have an access to personal information provided to the Company and also the right to request a copy thereof, or to request the delivery of such information to him/herself or to other data controller (if such information is in format that can be delivered). The Client has the right to request to the Company for a disclosure of the source of information of which the Client has not given consent for the storage.
- 5.3 Objection
The Client has the right to object the storage, use or disclosure of personal information related to him/her for the information that the Company collects without requiring consent from the Client (unless it is a compliance to the law) or the storage, use or disclosure for the purpose related to direct marketing or for researches.
- 5.4 Deletion, elimination or suspension
The Client has the right to request the Company to delete or dispose or make the personal information unidentified under the following circumstance: when such information is no longer necessary for storage purpose according to the storage, use or disclosure purpose, when the Client has withdrawn his/her consent and the Company has not legal authority to store, use or disclose such information, or when the Client opposes the storage, use or disclosure of such personal information and the Company cannot refuse, or when the Company fails to comply with the law related to personal information protection.
- 5.5 Editing information
The Client has the right to request the Company to edit his/her personal information stored to be accurate, current, valid and does not cause misunderstanding.
- 5.6 Withdrawal of consent
The Client has the right to revoke his/her consent in storage, use or disclose personal information that the Company has stored (unless legal limitation). However, such revocation of consent must not affect the storage, use or disclosure of personal information of which the Client has previously given consent. Upon the said revocation, the Company may not provide products and/services to the Client or the Client may not receive any customer privileges.
- 5.7 Exercising right by the Client as an owner of personal information as specified herein is a limited right where the Company may refuse the exercise of such right in case there is reasonable ground according to the law.
- 5.8 The exercise of right of the Client as an owner of personal information as specified herein, the Client must follow the procedures and attach evidence document as required by the Company, by contacting Call Center 1756 or giving written notice to Big C Supercenter PCL, 7th Floor, Big C Rajdamri Building, No. 97/11, Ratchadamri Road, Lumpini Subdistrict, Pathumwan District, Bangkok 10330, Thailand or contact customer service counter all branches nationwide, together with a copy of identification card and other document as required by the Company.
The Client can change or cancel the news subscription from the Company by contacting Call Center 1756 or online via Company's website.
The Company will store the Client's personal information until the time as permitted by law or to the time according to the purpose of such personal information storage, or until the time when the Client remains as a customer and/or users of the Company. However, the Company may continues holding the personal information of clients after the termination of the client as a customer and/or user in case it is considered necessary to continue the storage to meet the storage purpose, or for any necessity as the Company considers appropriate.
The Company is committed to provide options to the Client regarding personal information that the Company has stored. Hence, the Company has selected advance and highly secured technology for storage personal information of the Client. The access to the Client's personal information is supervised and determined properly where those who have an access to such data is identifiable. There is security system to prevent the access of unauthorized person.
The Company has the right to change this Personal Information Policy. Any changes will appear on the Company's website.
If the Client continues to use services or purchase products or contact the Company or have any relationship with the Company as a customer and/or user after the changes of this Policy, it shall be deemed that the Client has acknowledged and agreed to the changes thereof.
